RESPONSIBILITIES, TERMS, CONDITIONS and RELEASE OF LIABILITY

Responsibilities:
The responsibility of Good Earth Travel Adventures Ltd., (hereinafter referred to as GOOD EARTH) and/or its agents are limited. GOOD EARTH acts only as an agent for clients in regard to travel and assumes no liability for injury, damage, loss, accident, delay or irregularity which may be occasional either by reason of defect, through acts of defaults of any company or person engaged in conveying the passengers or in carrying out the arrangements of the tours, or direct or indirect acts of God, fire, breakdown in machinery or equipment, riots, strikes or from any causes beyond the control of GOOD EARTH. Tour Services including but not limited to guided tours and activities, lift tickets, transportation, room or lodging accommodations are furnished by independent contractors (suppliers) and do not act for or on behalf of GOOD EARTH. The acceptance of tour arrangements is deemed to be a consent of the above. GOOD EARTH is not liable or responsible in any way whatsoever for any act, error, or omission or for inconvenience, loss, damage, injury or death arriving out of tour arrangements.

In the event of inclement weather or other causes or events beyond the control of GOOD EARTH which results in delays, it shall not be the responsibility of GOOD EARTH to pay for resulting costs and expenses, including, but not limited to, additional lodging expense, additional meal(s) expense, or other similar expenses.

Prices:
GOOD EARTH guarantees that your trip price will not change once your trip is booked, unless there are changes made after the booking at which time you will receive a revised trip price. Our prices are in Canadian dollars, but we can also accept payment in USA dollars at the exchange rate in effect at the time of booking. We charge a single supplement to individual travelers who wish to ensure that they have private rooms throughout a trip. Canada’s 6% Goods & Services Tax (GST) applies on trips in Canada; approximately half of the tax is refundable to non-residents of Canada which GOOD EARTH applies for on your behalf and is reflected in the trip price.

Reservations and Payments:
An initial deposit of $500 per person (of which $175 is a non-refundable handling fee) is required no later than 7 days after verbal confirmation in order to secure space on a trip. Some lodging suppliers during peak or holiday times may require higher deposits; these will be confirmed to you at time of reservation. Additional amounts may also be necessary in order to obtain specific activities or services; these will also be confirmed at time of reservation. Upon receipt of deposit, a confirmation of receipt and final payment date will be sent to you.

Final payment is due 90 days prior to departure. Final payment for travel during Holiday Periods may be required sooner. For reservations made within 90 days of departure, full payment is due to confirm reservation.

In the case of late bookings, cheques are acceptable up to 46 days prior to departure. A service charge of $30 per occurrence will apply for returned cheques. Any payments received within 45 days of departure must be made with Cash, cheques, money order, cashier's cheque, wire transfer, Visa or MasterCard. A credit card imprint and signature for all payments will be taken upon your arrival in the destination.

Cancellations:
For purposes of this agreement, "land cost" is any and all other tour components, including but not limited to lodging, lift tickets, ground transportation, train travel and other services. All cancellations must be received by our office in writing or fax. Cancellation policies and fees are as follows:

Exceptions to this policy cannot be made for any reason, including those due to weather or personal emergencies. Please note: 

• There is no refund for arriving late or leaving a trip early. 
• Single supplements are considered part of the trip price and are subject to cancellation fees. 
• GOOD EARTH reserves the right to make route, hotel, activity and restaurant modifications as needed to ensure the comfort and safety of our customers.

GOOD EARTH does not purport to guarantee weather or snow conditions at any area or at any time nor will any refund be made should the passenger cancel the agreement with GOOD EARTH due to weather or snow conditions.

Trip Changes:
There will be a change fee of $25 for each change made while traveling on your vacation.

No Refunds For Unused Services:
Refunds or allowances will not be made for transportation, accommodations, guided tours, lift tickets, services, or other portions of the tour, which are unused on or after the tour departure date.

Trip Cancellation Protection and Medical Insurance:
Cancellation Protection - GOOD EARTH offers cancellation insurance which, if purchased, provides you with the following pre-trip protection:

Full (100%) refund of the total cost of your GOOD EARTH vacation package if canceling for ANY reason prior to the start date of your trip. Please ask us for a quote.

Medical Insurance - GOOD EARTH recommends that you are fully covered for medical insurance while traveling. Please check with your local insurance provider.

Car Rentals:
Each car rental day is counted for a 24-hour period starting from the time you pick-up your rental vehicle. You will be charged a late fee or an extra day fee for late returns. There is no refund for early return. Car rental prices do not include: collision damage waiver, gasoline, drop fees or extended days beyond the rental period. You must pay these charges directly to the car rental company. The minimum age is 25 years old for car rental, and a major credit card and valid driver license is required.

Lodging Security Deposit:
A security deposit may be required by some properties on check-in. Generally, a major credit card is required.

Release of Liability and Assumption of All Risks
I acknowledge that the cost of and participation in all GOOD EARTH trips is based upon trip participants executing this Release of Liability and Assumption of All Risk. Therefore, as lawful consideration for being permitted to participate on such trip(s), I hereby RELEASE AND DISCHARGE FOREVER GOOD EARTH FROM AND AGAINST ANY AND ALL LIABILITY ARISING FROM MY PARTICIPATION IN THE TRIP. I agree that this release shall be legally binding upon me personally, all members of my family and all minors traveling with me, my and their heirs, successors, assigns, and legal representatives, it being my intention fully to assume all the risks associated with this trip and to release GOOD EARTH from any and all liabilities to the maximum extent permitted by law.
